Can Foreigners Vote in U.S. Elections? (Part 1)


How U.S policies destabilize the integrity of our elections

and put foreigners in jeopardy.

Last week, Florida, Texas and Ohio each sued the Biden-Harris administration for obstructing their states from verifying the citizenship of “potentially ineligible” voters. The Texas lawsuit, filed in federal court on October 23, claims that nearly half a million voter registrations in the state did not use a Texas-issued driver's license or ID card to register, so “those voters never had their citizenship verified.”


Attorney General Ken Paxton argues that the current Democrat administration and the U.S. Department of Homeland Security are violating federal law and "refusing to answer valid requests…for the citizenship status of the over 450,000 people on Texas’s voter rolls for whom the State cannot verify their citizenship status using existing sources.” The federal lawsuit was filed in the U.S. Western District of Texas. Three days later, NPR, which the public presumes to be objective due to its taxpayer-funding, covered the lawsuits in a special series titled “untangling disinformation.” The lead sentence exposed the story’s unvarnished bias:

“As former President Donald Trump and his allies spread baseless conspiracy theories about Democrats bringing in noncitizens to vote illegally, GOP state officials are escalating last-minute demands on the Biden administration to check the citizenship of voters on their state rolls.”

NPR writers Jude Joffe-Block and Miles Parks went so far as to quote law professor Justin Levitt, a former Biden administration adviser, as saying, “The lawsuits are ‘in service of a fraudulent narrative — which is the notion that widespread numbers of noncitizens are intentionally registering and voting — which is patent garbage.’”


Had NPR reported objectively, its article would have stated that the states had filed federal court claims alleging the government was failing to perform its legal responsibilities to assist states in verifying citizenship. Instead, NPR smeared the lawsuits and speculated that their purpose was to serve a hypothetical narrative that none of the lawsuits made.


‘Patent garbage’ or unvarnished truth?


Florida's lawsuit, filed Oct. 16, claims the current administration is violating several federal laws in two ways:

 

First, 8 U.S.C. § 1373(c) requires the federal government to “respond to an inquiry by a Federal, State, or local government agency, seeking to verify or ascertain the citizenship or immigration status of any individual within the jurisdiction of the agency. . . .” Second, 8 U.S.C. § 1644 states, “no State or local government entity may be prohibited, or in any way restricted, from sending to or receiving from [federal immigration authorities] information regarding the immigration status, lawful or unlawful, of an alien in the United States.”


A peak into Michigan's voting process sheds like on the absence of citizenship checks nationwide.


Michigan's election laws may appear, at first glance, to have impressive safeguards in place, but don't be fooled. Currently, since we are within 14 days of an election, students may register to vote using their college ID and a utility bill (or an app showing their dorm room). No proof of citizenship required.


Beyond 14 days before an election, the Mitten State requires two pieces of ID in order to register to vote.


Here’s the rub: Neither of the two required items—a driver’s license or a Social Security Number—are any guarantee of citizenship.


Driver’s license: No assurance of citizenship


According to Michigan.gov:

To receive a driver’s license, a person must provide the following: “Proof of residency establishes that you live in Michigan. Legal presence establishes that you were either born in the U.S. or in a U.S. possession or territory, are a naturalized citizen or a foreign national who legally lives in the U.S. [Emphasis added].


Social Security Number: No assurance of citizenship


The U.S. Citizens and Immigration Services announced on March 28, 2024, that effective April 1, 2024, “new citizens may no longer need to visit an SSA field office to apply for an SSN….” Plus,

Noncitizens applying for naturalization using the new edition of Form N-400 (edition date 04/01/24) will be able to request an SSN or replacement card when submitting Form N-400.” [Emphasis added]. --ALERT: SSA changes Citizenship Verification Process.

 

Illegal migrants requesting asylum against deportation may also request a SSN.


Put in plain terms, applicants for naturalization and illegal migrants suing not to be deported may apply online and receive a Social Security Number.



No driver’s license? No SSN? No problem.

 

According to Michigan law (MCL 168.497):

 

(4) If an applicant for voter registration under subsection (2) does not have identification for election purposes, the applicant may register to vote if the applicant signs an affidavit [Emphasis added.] indicating that the applicant does not have identification for election purposes and the applicant provides 1 of the following documents that contains the applicant's name and current residence address:

    (a) A current utility bill.

    (b) A current bank statement.

    (c) A current paycheck, government check, or other government document.

What is going on?

 

According to U.S. Representative Claudia Tenney (R-NY), “Susan Rice, former President Obama’s key advisor, is heading up the operation of tasking our federal agencies to actually get votes from illegal immigrants.” Tenney made the claim during a Fox News interview with Maria Bartiromo.


Bartiromo asked if Tenney had proof of her claim that the Biden-Harris administration's party "are trying to recruit illegals, migrants, to vote in our presidential elections. Is that what you just said?"


Tenney replied, "There's a memo from Susan Rice that says we've got to figure out how we are going to get these illegal immigrants. It's going to be challenging to teach them how to make sure we get their votes in the ballot. They don't say whether they are going to make them citizens first or not.”

One thing is clear. It is hardly touting conspiracy theories to point out the vulnerabilities in our elections’ system. If anything, one might consider asking penetrating questions a person’s civic duty if we are to maintain a free society that is of, for, and by the People. Instead, one might turn the question around and ask: What could possess any news organization to cast shade on citizens for daring to ask civic-minded questions?
