Petition for Relief Filed in Federal Court

Michigan Fair Elections and United Sovereign Americans, Inc. joined six Michigan citizens who claimed they incurred harms in the 2022 election. The petitioners seek remedies and assurance of steps to prevent these errors going forward from Michigan's Attorney General and Secretary of State, as well as the Attorney General of the United States, in a Petition filed August 28 in Federal Court.


The remedies requested include: “Correction of Apparent Errors,” to “ascertain…the reasons why the 2022 errors occurred,” and “to ensure the integrity of Michigan’s… elections going forward.”


The Petition provides support that “systemic issues occurred in the 2022 combined Federal and state election.” It cited lack of specific response to evidence of registration issues uncovered by United Sovereign Americans in paragraph 84 on page 16 as follows:


  1. 100,229 registrations contained invalid addresses;

  2. 4,714 registrants were age discrepant (younger than 16 or older than 115);

  3. 2,204 registrations were back-dated new registrations;

  4. 7,481 registrations were illegal duplicates;

  5. 6,069 registrations had the voter removed and then added back;

  6. 11,511 registrations had double votes added and then removed;

  7. 57,903,469 registrations had votes altered post certification;

  8. 152,047 registrations were processed on a non-business day;

  9. 13,824 registrations had invalid registration status;

  10. 4,235 registrations contained invalid names.


Clearly stated, is that the redress is “not to re-visit the results of the 2020 Presidential election.” Rather, petition outlined harms incurred by these citizens should election officials not correct the abridgement of guarantees of citizenship under:


  • The U.S. Constitution,

  • The National Voter Registration Act (“NVRA”), “passed for the purpose of ensuring accurate and current voter registration rolls to enhance the integrity of elections,” and

  • The Help America Vote Act (“HAVA”) which exists in part to “establish minimum election administration standards for States and units of local government with responsibility for the administration of Federal elections, and other purposes.”


A Sept. 2, 2024, Press Release issued by United Sovereign Americans (USA) points out that, by the standard set out by Federal law, there should be no more than 36 errors statewide


The irregularities cited in the Petition significantly exceed that number which amounts to the acceptable error rate for Michigan in 2022 set forth by federal law. That media release further explains, “Those voting standards, in effect at the time HAVA became law, allowed for one error per 500,000 ballot positions.”


Paragraph one of that Petition explains, “the Congress of the United States has outlined the minimum standards which must be maintained by every state for a federal election to be considered reliable (and) ... those minimum standards were not met by Michigan officials” in the 2022 federal election.


“Failure to effectively uphold ALL laws enacted to ensure fair elections and to uphold the ideals of our Constitutional Republic is NOT optional!” championed Frederick Nienstedt, Delegate to the Macomb County Convention from Precinct 18. He further added that “the fraudulent filing of...applications to vote in Muskegon County demonstrate the failure of our elected officials.”


The petition also clarified they are not, at this time, accusing any particular person or entity of election fraud. Rather, “Petitioners’ purpose in describing types of voter fraud is to set forth the harms Congress sought to avoid by implementation of HAVA and NVRA.”


The United Sovereign Americans media release states it has plans to file in additional states. Similar suits have already been filed in Maryland, Pennsylvania, Florida, North Carolina, Texas, and Ohio.
